	<title>The EU Criminal Enforcement (IP) Directive</title>
<description>
 The Criminal Enforcement Directive (CED) is an initiative by the EU law making authorities to harmonise the definition and enforcement of criminal sanctions in relation to some forms of IP infringement. It follows on from the civil enforcement directive which has been implemented across the EU and which harmonised various aspects of civil IP litigation. The CED, however, has not yet been implemented and is comparatively early in the law making process. Originally covering all IP it has already been restricted by amendment to exclude patents in the face of strong criticism that this could cause enormous problems to legitimate business. The amended version is still subject to criticism and the process currently seems to have stalled altogether. Apart from question marks as to the power of the EU to deal with criminal law issues, the main criticism is that the CED goes far beyond its main purpose. The idea is that piracy and counterfeiting should be dealt with as strongly as possible by member states and the CED would certainly create appropriate powers to do this. However it is framed so broadly that any number of other commercial activities could be significantly impeded if it came into force in its current form. As a result the process has slowed for the time being and the CED is nowhere near coming into force. It has, at least, stimulated an interesting and useful debate about IP enforcement, however...
